EXTRAJUDICIAL KILLING AND FAKE ENCOUNTERS


An extrajudicial killing is the killing of a person by government authorities or individuals without the sanction of any legal process or judicial proceeding. The three pillars of the criminal justice system consist of law enforcement authorities, courts or judiciary, and then jail for punishment specified by the judiciary. These all constitute the rule of law but we are able to audit that the law enforcement authorities are taking the law in their hand whereas it should be the judiciary to decide. A report from the National Human Rights Commission revealed that 1,782 cases of fake encounters has been undertaken in India during 2000-20017 and also a lot more cases of extrajudicial killings, with no actual figure available.

Recently a history-sheeter, Vikas Dubey who was accused of killing eight police personnel in Uttar Pradesh was caught in Madhya Pradesh, he just surrendered there and was brought to Uttar Pradesh where he was encountered. The official statements are obviously faking the incident that the vehicle in which he was taken back met with an accident. He while trying to flee by snatching police gun, the police personnel encountered him. This all was already procrastinated by the number of people a day before it. He was obviously a murderer of many people but he was still moving freely there which is only possible with the help of political supports, and there are many such cases similar to this from various states. Undoubtedly, he was a sinner and should be given a death sentence or life imprisonment but encountering him without following the rule of law was illegal and illogical. Moreover, the information he was having about many of the politicians from different parties could have given a lead to the root of such uprisings. But now all these are hidden and again another Vikash Dubey will come and a similar incident will go on.

Most of the people will argue that “Justice Delayed, Justice Denied”, then it is the fault of the government, not justice, the number of judges is still far less than what must be there for 1000 people and there are no proper fast track courts in abundance to solve small cases. Someone will also argue that “Police have caught many such criminals but none has given statements”, then firstly note that police are also faulty as they work under political influence. Though the criminals will share the information it will be hidden inside the treasure and will never be out. If they were given the security of life then you will have all the truths which can create a seismic around the political parties.

Coming to the conclusion, extrajudicial killing is not only illegal but it is also abiding the rule of law. Also due to such extrajudicial killing often innocent gets suffered and there many instances and proofs. Overall, it is on government and people but we see people enjoying such acts and it is sure those enjoyments are only for some time period until the same (fake encounter) happens with one’s family.
